OK, the truth is we live in a world that has issues. Such being the case, this Official Artists for a Better World International™ “Terms of Use” (TofU) exists to protect AFABW Int and its members. (Stated differently, “Welcome to the most boring part of this website.”) So, brace yourself. Here we go:

By participating in the activities of this site, you are signifying your agreement with these rules. If you do not agree to these rules, do not use this site.

1. COPYRIGHT, TRADEMARK NOTICE, USE RESTRICTIONS:
Graphics, text, video, audio or other media on this site are intellectual and artistic properties owned by Artists for a Better World International™ and the artists who are listed in the Artists for a Better World International™ Artists Directory and website, and unless clearly stated otherwise are to be considered copyrighted works that require the express written permission of Artists for a Better World International™ or the artists who own them to be used in any fashion and may not be copied, distributed, republished, downloaded, posted, or transmitted in any way, all rights reserved. Artists for a Better World International™ and the “blackened globe with newly brushed paint, encircled by pens, musical notes and brushes” are Trade Marks owned by Artists for a Better World International™ and may not be reproduced in any fashion without the express written permission of Artists for a Better World International™, all rights reserved.

The Site as a whole is protected by United States and international copyright law and Artists for a Better World International™ owns all worldwide rights, titles and interests to this Site.

The contents of this Site, and the Site as a whole, are intended solely for personal, noncommercial use. You may not distribute, modify, transmit, reuse, re-post or use the content of the Site for public or commercial purposes.

All questions concerning the construction, interpretation and enforceability of these Official ToU shall be governed by the laws of the State of California and of the United States.

2. DISCLAIMER:
The Artists for a Better World International™ website is intended as a medium for artists and artists groups to communicate and collaborate with the idea that artists can improve the world through their activities. The executives and pertinent staff of Artists for a Better World International™ reserve the right to refuse usage or membership to anyone, through this site, or through any other means and are not required to state why.

Artists for a Better World International™ executives and pertinent staff reserve the right to terminate any membership and are not required to state why. If this ToU regarding membership is not acceptable and agreed to, then you may not register for membership and any membership without full agreement of this point, or of any point on this ToU, is null and void.

The Artists for a Better World International™ website may contain opinions, recommendations or advice by members, associates or staff. These are not necessarily the opinions, recommendations or advice of Artists for A Better World International™ and are not to be taken as such.

As the creator and owner of this site, Artists for A Better World International™ reserves the right to originate basic rules that govern the use of our Site and to change the rules as often as we feel is necessary. New rules will be effective when posted on this web site. If rules change, your continued use of the Site constitutes your agreement to follow the new rules.

3. ARTISTS DIRECTORY WEBSITE SUBMISSION AND DISCUSSION SITE POSTING:
You acknowledge that you are responsible for whatever material you submit, and you, not Artists for a Better World International™, have full responsibility for its content, including its legality, reliability, appropriateness, originality or copyright.

Artist for a Better World International™ and pertinent staff reserve the right to refuse the inclusion of, or may remove, any material from any media for any reason, and are not required to state why.

With any use of an Artist for a Better World International™ discussion board or forum, including the Artist for a Better World International™ Facebook Group, users take full responsibility and liability for the content and for any mistakes, defamation, libel, slander, omissions, falsehoods, obscenity, profanity or material that may be deemed as inappropriate or offensive you might post or encounter. Artists for a Better World International™ executives and pertinent staff may remove any post to the discussion boards, forums, Facebook Group or prohibit the ability to post for any length of time or permanently bar any user of the discussion board for any reason, and are not required to state why. Any user who wishes to use the discussion board that does not agree to this ToU is not eligible to use the discussion board.

Additionally, refer to the Terms of Service published on the Facebook website for specific information regarding that service, which hosts the Artist for a Better World International™ Facebook Group.

4. MEMBERSHIP, FEES AND LEGAL RECOURSE:
Memberships, fees and donations support Artists for a Better World International™. Membership criteria and fees may change at any time.

Membership fees, dues and donations to Artist for a Better World International™ are not refundable.

Your use of this Site is at your own risk. This Site and its contents are provided on an “as-is” basis with no warranties of any kind, express or implied, including warranties of title, merchantability or fitness for a particular purpose. By your use of the site, you acknowledge, that you assume full responsibility for any and all costs associated with all servicing or repairs of any equipment you use in connection with this site, and that Artists for a Better World International™ shall not be liable for any damages of any kind related to your use of this site.

By participating in this Site, participants agree to release and hold Artists for a Better World International™and its employees, officers, directors, shareholders, agents, representatives parent companies, subsidiaries, advertising and promotion agencies, and legal advisors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with Artists for a Better World International™ .

Artists for a Better World International™ or any successor Site owner reserves the right to make upgrades and enhancements to this site in the future.

Any disputes between Artists for a Better World International™ and a member, a terminated member or a user that cannot be resolved through communication between the parties shall be resolved through a two-step dispute resolution process administered by the applicable procedures of the American Arbitration Association (“AAA”), involving, first a mediation before a mediator or panel of mediators, followed if necessary, by final and binding arbitration before the same or, if requested by either party, another panel from the AAA. BY ENTERING INTO THIS CONTRACT BOTH PARTIES ARE GIVING UP THEIR CONSTITUTIONAL RIGHT TO HAVE ANY SUCH DISPUTE DECIDED IN A COURT OF LAW BEFORE A JUDGE OR JURY, AND INSTEAD ARE ACCEPTING THE USE OF MEDIATION AND ARBITRATION. The demand for mediation must be in writing and must be made by the aggrieved party within sixty days of the event giving rise to the demand. A Request for Dispute Resolution form to initiate the mediation process is available from our organization. The mediation and, if necessary, the arbitration shall take place in Los Angeles County, California, and shall be based on the laws of the State of California. The arbitrator’s power to award a remedy shall be limited to awarding monetary damages for lost wages and/or benefits and damages. The decision of the arbitrator shall be binding and conclusive on the parties and not revisable for error of law or legal reasoning of any kind. Judgment upon the award rendered by the arbitrator may be entered in any court having proper jurisdiction. Each party to the mediation/arbitration shall bear their own costs including attorney’s fees. The fees for the mediator/arbitrator shall be paid equally by both parties.
